Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all orders placed by consumers in our online shop pawmony.shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code).

§ 3 Conclusion of the contract

(1) The presentation of products in the shop is not a legally binding offer but a non-binding invitation to place an order.

(2) By clicking the “Buy now” button, you make a binding offer to purchase the goods in your cart. Before that, you can check and correct all your details.

(3) Immediately after your order, you will receive an order confirmation by email with our bank details. The purchase contract is concluded when you receive this order confirmation.

(4) The language of the contract is German. We store the contract text. You will receive your order details by email; you can view these terms on this page at any time.

§ 4 Prices and shipping costs

All prices are final prices in euros and include statutory VAT. Shipping within Germany is free of charge. We currently deliver to addresses in Germany only.

§ 5 Payment

(1) Payment is made in advance by bank transfer. You will receive our bank details with the order confirmation.

(2) Please transfer the total amount within 7 days and use your order number as the payment reference. If payment is not received in time, we may withdraw from the contract.

§ 6 Delivery

(1) We ship the goods once your payment has been received. We usually process your order within 1–2 business days of receiving payment; delivery then usually takes 3–7 business days, unless otherwise stated for the product.

(2) Some products are limited. If a product is unavailable despite your order, we will inform you without delay and refund any payments already made immediately.

§ 7 Retention of title

The goods remain our property until paid in full.

§ 8 Right of withdrawal

As a consumer, you have a statutory right of withdrawal. You will find all details in our Right of Withdrawal. You can also conveniently declare your withdrawal using the “Withdraw from contract” function on our website.

§ 9 Warranty

The statutory warranty rights apply. Please report any obvious transport damage to us as soon as possible. This does not affect your statutory rights.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In cases of slight negligence, we are only liable for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

§ 11 Use of our website

(1) Please use our website only in accordance with applicable law. In particular, it is not permitted to provide false information, transmit malicious software, circumvent security features or place orders with fraudulent intent.

(2) The texts, product descriptions, images, logo and design of this website are protected by copyright. Any use beyond what the law permits requires our prior written consent.

§ 12 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law applies only insofar as it does not deprive you of the protection of mandatory consumer protection provisions of the country in which you have your habitual residence.

Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
